Privacy Policy

1.1 NEXTOPICON MEDIA INC. considers your privacy highly important. To better protect your privacy, we provide this notice explaining our information practices and the choices you can make about the way your information is collected and used.

2.1 This policy notice applies to personal information collected or submitted through use of our website and mobile application (collectively the “Platform”) 

2.2 We use the term “personal information” as it is defined in the Personal Information Protection and Electronic Documents Act, SC 2000, c 5 (“PIPEDA”). As such, for the purposes of this policy, personal information means information about an identifiable individual, but does not include the name, title, or telephone number of an employee of an organization.

2.3 We may collect the following types of information:

(a) personal information when you set up an account with us;

(b) personal information provided by you when you use the Platform;

(c) personal information when you interact with us, such as when you download our mobile application or purchase products or services we offer, when you subscribe or register to use our products or services, and when you provide us feedback or respond to surveys we ask you to participate in;

(d) aggregated information generated by our system or third party systems we use, which track traffic to and from the Platform, but which does not relate to you personally; and

(e) other information that does not personally identify you.

3.1 We may disclose:

(a) aggregated tracking information and other non-personally identifying information to our partners, agents, or advertisers;

(b) your personal information to third parties when we are legally required to do so; and

(c) your personal information to third parties provided we have your consent, which will generally be obtained at the time we collect the information.

4.1 We are committed to keeping your information secure and maintaining its accuracy. We make all commercially reasonable efforts to ensure that personal information collected from you is protected against loss and unauthorized access. Personal information is collected and stored by us in a secure manner.

4.2 Any other companies and individuals who we may employ from time-to-time to perform functions on our behalf are required to protect any personal information accessed in a manner consistent with this policy.

5.1 As described in our Terms of Use, persons must be of “Minimum Age” age 18  to use our Platform. Accordingly, we do not knowingly collect or solicit information from anyone is under the minimum age or knowingly allow such persons to use our Platform. Our Platform is solely directed at persons over the Minimum Age. Should we learn that we have collected personal information from a person under the Minimum Age we will promptly delete that information.

6.1 In accordance with Canada’s Anti-Spam legislation we may use your personal information so that we may send you commercial electronic messages (CEMs). Unless such messages are sent subject to exemption we will obtain your prior implied or express consent in accordance with this legislation.

6.2 You may withdraw your consent to receive CEMs from us at any time by using the unsubscribe mechanism contained in all of our electronic communications. 

6.3 We do not install or cause to be installed any computer programs on your computer system that requires your consent under CASL. 

7.1 You may e-mail us at  info@nextopi.com any time to request a copy of the personal information we have in our possession about you and/or to ask us to modify or remove your information from our online database. We will take all reasonable steps to verify your identity before taking any action in respect of such requests.

7.2 Should you request a copy of the personal information we have in our possession about you, we will provide that information to you within 30 days of receipt of your request. In accordance with PIPEDA, we may extend this time period under the following circumstances:

(a) if responding to the request would interfere to an unreasonable degree with our activities;

(b) if responding to the request would require us to undertake consultations that would make it impracticable to meet the 30-day time period; or

(c) if you require the copy of your information in an alternate format and it would take significant amounts of time to convert it.

In such circumstances, we will contact you within the first 30 days to explain the reason for the delay and advise you of your right to complain to the Privacy Commissioner about the delays.

7.3 Please be aware that:

(a) access to personal information may be denied in accordance with the exemptions set out in the applicable sections of PIPEDA; and 

(b) it may not always be possible to completely modify or remove information in our database.

8.2 All complaints made to us regarding our information practices will be promptly investigated upon receipt and appropriate measures will be taken to resolve them.

9.1 We reserve the right to update our privacy policy at any time without notice. All updates to our privacy policy will be made readily available and accessible through our website and mobile app . The privacy policy posted shall be deemed to be the privacy policy then in effect.

9.2  Your use of our Platform indicates your acknowledgment of this privacy policy and consent to the collection, use, and disclosure of your personal information in accordance with this privacy policy. 

10.1 We reserve the right to co-operate fully with local, provincial and federal officials in any investigation relating to any personal or any purported unlawful activities.
